The agreement between you and Simonina, written to be read.
These Terms of Service (“Terms”) govern your use of Simonina, meaning our websites, apps, and the AI companions you talk to (together, the “Service”), provided by Simonina (“we,” “us,” “our”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is part of them. If you don’t agree, please don’t use the Service.
Simonina is made for adults. You must be at least 18 years old (or the age of majority where you live, if that’s higher) to create an account or use the Service. By using Simonina you confirm that you meet this requirement. The Service is not intended for, and is not directed to, anyone under 18, and we don’t knowingly allow them to use it. If we learn that an account belongs to someone under 18, we’ll close it and delete the associated data. You also confirm that you aren’t barred from using the Service under the laws that apply to you, and that you’ll use it only for lawful, personal, non-commercial purposes unless we’ve agreed otherwise in writing.
You’re responsible for your account and for keeping your login credentials secure. Give us accurate information when you sign up, keep it current, and let us know promptly if you believe your account has been accessed without your permission. You’re responsible for activity that happens under your account. One person, one account. Don’t share it, sell it, or let someone else use it. You may close your account at any time (see Section 15).
Simonina’s companions are artificial intelligence. They are not real people, and everything they say or generate is AI-generated fiction, even when it feels personal. A companion can be wrong, can misremember, and can say things that don’t reflect our views or anyone’s. Knowing exactly what you’re talking to is part of using Simonina well, and we’ll always be clear that it’s AI. We’ll never pass a companion off as a human, a doctor, or a therapist.
By using Simonina, you agree not to:
We may remove content, or limit, suspend, or end access, for violations of these rules. Serious or illegal abuse may be referred to law enforcement.
Simonina is an adults-only service, and within it, a good deal of where a conversation goes is yours to steer. The Service carries a protection setting that is on by default. Where the Service allows it, an adult account holder may turn that setting off, and a companion will then engage genuinely with what you write. That is your choice to make, and you are responsible for making it.
We may make features available on some plans and not others, and we may limit or withhold them in particular countries or through particular app stores where the law or a distribution partner requires it.
The limits in Section 5 do not move. No setting changes them. Nothing involving minors, and nothing involving real, identifiable people without their consent, is permitted in any mode or on any account, and our safety systems keep working regardless of how the setting is configured.
The companions you create and the things you write are yours. You keep whatever rights you have in them.
For Simonina to work, we need your permission to hold and handle what you write: to show your messages back to you, keep your companion’s memory consistent, back your data up, and keep the Service safe. So you give us a limited, worldwide, non-exclusive, royalty-free licence to store, process, and use your content only for those things. Those words are narrower than they sound. Worldwide, because the servers running the Service may sit in a different country from you. Non-exclusive, because it stays yours and you can do whatever you like with it. Royalty-free, because neither of us is charging the other.
What we don’t take matters just as much. We can’t sell your content, publish it, hand it to anyone else to use, or keep it once you’ve deleted it, apart from copies we’re required to keep or that sit in routine backups for a limited time before they’re overwritten.
We do not use your conversations to train our AI models. Your chats are for you and your companion, not a dataset. This is a deliberate promise, not the industry default. If we ever want to use content to improve the models, we’ll ask for your clear, opt-in permission first.
If you send us feedback or suggestions, you allow us to use them freely to improve the Service, without any obligation to you.
Because a companion’s replies and images are generated by AI, they can be inaccurate, unexpected, or not to your taste, and they don’t represent our advice or opinions. You’re responsible for how you use what the Service generates, and for checking anything you rely on. You should not treat AI-generated content as fact, or as professional guidance of any kind (see Section 13).
AI output isn’t unique by nature: another user who writes something similar may receive similar or identical output, and we can’t grant anyone exclusivity in what a model generates.
We own the Service itself: our software, models, designs, and the Simonina name and brand. Nothing in these Terms transfers that to you. We grant you a personal, limited, non-transferable, revocable right to use the Service under these Terms, and everything not expressly granted is reserved. Don’t use our trademarks or branding without our written permission.
Parts of the Service may be free; others may require a paid subscription. Before you pay, we’ll show the price, the billing cycle, and any renewal terms clearly. Payments are handled by our third-party payment processors, and we don’t store your full card details ourselves.
Simonina runs on infrastructure and AI services provided by other companies, and a few of the things you do here happen on someone else’s side. If you sign in through another company, such as Google, that happens on their systems and under their terms. A subscription bought through a transaction with that store. We’re not responsible for how those companies run their services, or for what their own terms say.
How we handle your information is described in our Privacy Policy, which is part of these Terms. In short: your companion remembers what matters, and we don’t treat your conversations as an archive to mine or a dataset to train on.
Simonina is a companion, not a medical, mental-health, legal, or financial professional, and it is not an emergency or crisis service. Don’t rely on it for those. If you’re in crisis or thinking about harming yourself, please contact your local emergency number or a crisis line right away.
We respect intellectual-property rights and expect you to as well. If you believe content on the Service infringes your copyright, send us a notice at [email protected] with enough detail to identify the work and the material in question, your contact information, and a statement of good-faith belief that the use isn’t authorized. We’ll respond appropriately, which may include removing the content, and we may terminate the accounts of repeat infringers.
You may stop using Simonina and delete your account at any time. We may suspend or end your access if you violate these Terms, if it’s needed to protect the Service or other users, or where we’re required to for legal or security reasons. We’ll act reasonably and, where appropriate, give you notice. Sections that by their nature should survive termination, such as content licence carve-outs, disclaimers, limitation of liability, indemnification, and dispute resolution, will continue to apply.
If we end your access because you broke these Terms, a paid period isn’t refunded. You can close your account yourself at any time, and our Privacy Policy explains what happens to your data when you do.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We work hard to make Simonina reliable, but we don’t promise it will be uninterrupted, error-free, secure, or that a companion’s output will meet your expectations. Some jurisdictions don’t allow certain warranty exclusions, so some of these may not apply to you.
To the fullest extent permitted by law, Simonina and its people won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 100. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
Nothing in these Terms excludes or limits liability that can’t be excluded or limited under the law that applies to you, such as liability for death or personal injury caused by negligence, or for fraud.
To the extent permitted by law, you agree to indemnify and hold Simonina harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your content, or your violation of these Terms or of someone else’s rights.
Talk to us first. Most things are quicker to fix in an email than in a formal process. Before either of us starts anything formal, send a description of the problem and what you’d like done about it to [email protected], and give us 60 days to try to sort it out. We’ll do the same for you.
If you live in the EEA or the UK, the rest of this section doesn’t apply to you. Your disputes stay with the courts and the consumer-protection rules of your own country.
Please read this section carefully; it affects how disputes are resolved. If a dispute between you and Simonina can’t be resolved informally, you and we agree to resolve it through binding individual arbitration rather than in court, except that either party may bring a qualifying claim in small-claims court, and either party may seek injunctive relief for intellectual-property or unauthorized-access matters. To the extent permitted by law, you and we waive any right to a jury trial and to participate in a class or representative action; claims may be brought only on an individual basis.
Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with your account details and a clear statement that you opt out; if you do, this Section 19 won’t apply to you. These Terms, and any dispute, are governed by the laws of the jurisdiction in which Simonina is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections of your home country. Nothing here removes rights you can’t waive under the law that applies to you.
We may update these Terms as the Service evolves. If we make material changes, we’ll let you know through the Service or by email before they take effect. Your continued use after the changes take effect means you accept the updated Terms; if you don’t agree, please stop using the Service.
These Terms, together with the Privacy Policy and any terms you agree to for specific features, are the entire agreement between you and Simonina about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn’t a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
